RE: Notice of Court Ordered Release of School Student Record Information
Dear Parents:
This is to advise you that on June 14, 2023, the District received the enclosed court order/subpoena requiring it to release limited school student record information to the United States Department of Labor (US DOL) related to an investigation falling under the Fair Labor Standards Act (FLSA). The FLSA addresses wage, overtime, child labor and personnel record keeping matters, and the release is in support of a child labor investigation being conducted by the Department. The FLSA does not address immigration or citizenship matters.
You are receiving this notice because information from your child’s school student record falls within the information ordered to be released by the court. Per agreement with the US DOL, the records to be released include, and are limited to:
- · Your child’s name, birthdate and photo identification on file with the District; and
- · Contact information for the students (if over 18) and/or their parents/guardians, including phone number and email address.
The US DOL, has assured the District that the information released to it will be maintained as confidential consistent with applicable statutes and regulations, including the Federal Privacy Act, federal freedom of information laws and federal court rules of civil procedure governing the redaction of certain private information in public court filings. With respect to the information to be released, the court rule requires use of initials of minors and not full names and only birth years, not full birthdates.
As required under the Illinois School Student Records Act, the District will comply with this order, and you have five school business days, or until June 22, 2023, to exercise your right to inspect, copy and/or challenge the accuracy, relevance or propriety of any entry in the school student records prior to the records release. A general challenge to the release of the information, however, must be filed with the court that issued the order.

RE: Aviso Sobre la Orden Judicial de Divulgación de Información de Registros Escolares de Estudiantes
Estimados Padres:
La presente es para informarles que el 14 de junio del 2023, el Distrito recibió la orden judicial/citación adjunta que requiere que divulgue información limitada de registros escolares de estudiantes al Departamento de Trabajo de los Estados Unidos (US DOL, por sus siglas en inglés) relacionada con una investigación que cae bajo la Ley de Normas Laborales Justas (FLSA, por sus siglas en inglés). La FLSA aborda asuntos relacionados con salarios, horas extras, trabajo de menores y mantenimiento de registros de personal, y la divulgación es en apoyo de una investigación sobre trabajo de menores que está realizando el Departamento. La FLSA no aborda asuntos de inmigración o ciudadanía.
Usted está recibiendo este aviso porque la información del registro de estudiante de la escuela de su hijo/a cae dentro de la información ordenada para ser divulgada por la corte. Según el acuerdo con el US DOL, los registros que se divulgarán incluyen, y se limitan a:
- ● Nombre, fecha de nacimiento y documento de identificación con fotografía registrado con el Distrito; y
- ● Información de contacto de los estudiantes (si son mayores de 18 años) y/o sus padres/tutores, incluidos el número de teléfono y la dirección de correo electrónico.
● El US DOL ha asegurado al Distrito que la información que se divulgue se mantendrá confidencial de conformidad con las leyes y reglamentos aplicables, incluida la Ley Federal de Privacidad, las leyes federales de libertad de información y las reglas de procedimiento civil de los tribunales federales que regulan la redacción de cierta información privada en los expedientes judiciales públicos. Con respecto a la información que se divulgará, la ley judicial exige que se utilicen las iniciales de los menores y no los nombres completos, y sólo los años de nacimiento, no las fechas completas.
Como lo exige la Ley de Registros Escolares de Estudiantes de Illinois, el Distrito cumplirá con esta orden y usted tiene cinco días hábiles escolares, o hasta el 22 de junio del 2023 para ejercer su derecho de revisar, copiar y/o impugnar la exactitud, pertinencia o propiedad de cualquier información en los registros de los estudiantes de la escuela antes de la divulgación de los registros. Si desea ejercer este derecho a revisar, copiar o cuestionar los registros que se divulgarán, o si tiene alguna pregunta sobre este aviso, comuníquese con mi oficina al (224) 303-1017 o envíe un correo electrónico a mi asistente legal, Alina Hernández a [email protected].
Sin embargo, se debe presentar una impugnación general a la divulgación de la información ante el tribunal que emitió la orden.
